General terms and conditions of sale
ARTICLE 1 - PURPOSE
Bellon & fils (hereinafter Thea Jewelry, the company's brand name) has capital of €225,000, is registered in the Romans sur Isère Trade and Companies Register under no. 313 720 906, and has its registered office at 42 rue Carl Von Linné 26500 Bourg-lès-Valence, France, intra-Community VAT no. FR54313720906, landline 04 26 99 72 73, and previously owned the website available at www.thea-jewelery.com.
This document (General Terms and Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, any person browsing the site www.thea-jewelry.com, hereinafter referred to as the user, and on the other hand THEA JEWELRY, registered with the ECB under number 0898 355 897, and whose registered office is located at Rue Engeland 555 - 1180 Brussels - Belgium.
Consequently, by accessing and using the www.thea-jewelry.com website, the user agrees to abide by all the conditions of use described below. Users are informed that these conditions may be updated at any time. They should therefore consult this page regularly to take note of any changes that may be made.
Any person who is incapacitated, in particular within the meaning of article 1123 et seq. of the French Civil Code, may not under any circumstances purchase from this site.
ARTICLE 2 - ORDERING
The products offered for sale on the www.thea-jewelry.com website are 14 carat gold jewellery (yellow, pink, white) (after 01/02/2024 gold jewellery is manufactured in 18 carat), silver or vermeil jewellery made to order by the designer Emilie Duchêne.
The characteristics of the jewellery are predefined as far as possible on the www.thea-jewelry.com website on the web page of each product (typography, illustrative photographs, etc.), which enables the user to know, before the final order is placed, fake patek philippe twenty the essential characteristics of the jewellery ordered. The user acknowledges that his acceptance is made in consideration of these descriptions. Any dispute concerning the nature of the article must be referred to the product description.
The order process is as follows:
Choice of items and their essential characteristics ;
Add to basket ;
Validation of basket contents ;
Identification on the www.thea-jewelry.com website, if the user is not already identified;
Choice of delivery method ;
Choice of payment method and acceptance of the T&Cs ;
Payment confirmation ;
During these various stages, the user can view the details of their order and its total price, and correct any errors, before confirming it.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of any other terms and conditions. All data supplied at the time of the order and the confirmation thereof shall constitute proof of the transaction.
Once the order has been validated on the site, the user acknowledges that its acceptance constitutes a firm and irrevocable commitment: the sale is considered complete, and the price is immediately payable by the user. The user then no longer has any right of rectification, exchange or return (particularly in the event of a size or text error).
Thea Jewelry then sends an e-mail confirming the order. This e-mail only confirms receipt of the order by Thea Jewelry.
Once the order has been confirmed, it takes approximately 3 weeks for each item to be created. Thea Jewelry sends an information email to the user when each piece of jewellery has been created. None of these emails constitutes acceptance of the order. No sales contract is formed between the parties until Thea Jewelry sends confirmation by e-mail that the products ordered have been sent to the user, and only the products listed in the e-mail confirming dispatch constitute the subject of the said contract.
Thea Jewelry reserves the right to cancel or refuse any order from a user with whom there is a dispute relating to the payment of a previous order, or who presents any form of risk in its eyes.
Thea Jewelry undertakes to honour orders received on its website only within the limits of available stocks. If one or more items ordered are not available, the company undertakes to inform the user as soon as possible and, if necessary, to reimburse the user within 45 days of payment of the sums paid. The user's order will then be automatically cancelled.
All prices quoted on the www.thea-jewelry.com website are in euros, inclusive of tax and exclusive of delivery charges.
The prices of items offered on the www.thea-jewelry.com website are valid for 24 hours from the date of their publication on the website. Items are invoiced on the basis of the prices in force at the time the order is registered.
The price is payable in full, in a single instalment.
The items remain the property of Thea Jewelry until full payment has been received.
Thea Jewelry makes every effort to ensure that all details, descriptions and prices appearing on its site are accurate, but errors do occur. If an error is found in the price of the goods that the user has ordered, one of the members of Thea Jewelry will inform the user as soon as possible by e-mail and give the user the choice of reconfirming the order at the actual price or cancelling it.
Payment is due by the user immediately after placing the order. The user then proceeds to pay for the order via the Stripe system. The order will be processed upon receipt of Stripe approval, in accordance with the procedure described in article 4.
An electronic invoice may be provided by the site. In this case, the user must specify the e-mail address to which the invoice is to be sent.
VAT payment conditions:
Unless otherwise indicated, the prices displayed on the site include VAT at the Belgian rate.
- Shipment to Belgium:
Individuals and businesses: the sale includes VAT at the Belgian rate of 21%.
- Shipment to another European Community country:
Individuals: the sale includes VAT at the Belgian rate of 21%.
Businesses: the sale is VAT-exclusive (provided that a valid intra-Community VAT number is supplied).
ARTICLE 4 - PAYMENT TERMS
The site has chosen to receive credit card payments via the secure payment system, which encrypts all information relating to the use of the card during the online payment operation via the site.
The following cards are accepted: Visa, MasterCard, Bancontact, ApplePay, Alma or American Express. The online payment page asks users to enter their card number, expiry date and security code (3-digit number on the back of the card).
The site cannot be held responsible for the consequences of the use of the credit card (fraudulent or otherwise) by third parties, including through intercepted messages.
When the order is complete, the user is redirected to the secure site for the full payment transaction. This mechanism guarantees the confidentiality of payment data (in particular credit card numbers), as the site is never aware of the user's credit card number, which the financial institution receives in encrypted form.
Once the payment has been accepted and confirmed, the selected payment platform verifies and executes the payment.
Ownership of the product is not transferred until full payment has been made, regardless of the date of delivery.
The transfer of risks takes place when the product is delivered to the user, if the user is a private individual (consumer within the meaning of the Belgian law of 6 April 2010 on market practices and consumer protection).
In the case of a sale to a professional, the risk of loss is transferred to the professional as soon as the package is handed over to the carrier.
The date shown on the delivery document is valid proof of the delivery date.
ARTICLE 6 - DISPATCH AND DELIVERY
As the jewellery sold on the www.thea-jewelry.com website is made to order, the manufacturing time for a piece of jewellery ordered on the website is approximately 3 weeks from confirmation of the order. The Thea Jewelry company will send an e-mail to inform the user when the jewel has been made.
As of this email, the order is prepared and shipped by Thea Jewelry as soon as possible, within a maximum of 45 days from the completion of the product (subject to validation of payment). A new e-mail is sent to the user when the parcel is sent by Thea Jewelry.
Deliveries are made anywhere in the world.
Products are delivered to the address indicated by the user during the ordering process.
Delivery is handled by DHL for all countries.
Fees are free.
Products are only delivered during the 5 working days of the week. The user is informed that any order placed on the site on a Friday afternoon will not be processed until the following Monday.
Delivery will take place within :
- 1 to 2 working days for Belgium and France
- 2 to 10 working days for the rest of the world
These times are given for information purposes only.
Thea Jewelry declines all responsibility for any delay, loss of ordered products or strikes due to postal or transport services. In these cases, the user must take the appropriate steps directly with the postal services or carrier.
In order to ensure their perfect condition and safety during transport, all products are carefully packaged by Thea Jewelry in accordance with applicable standards. The user must check the packaging and the products at the time of delivery.
Any problem with the items delivered (damaged items, missing items, broken items, defective items ...) must be notified to the company Thea Jewelry within 3 days (including holidays) of delivery (date of postmark) and express all reservations or claims relating to non-conformity or defect of items by e-mail (contact@thea-jewelry.com) and by letter with acknowledgment of receipt to :

No claims will be accepted after this period.
ARTICLE 7 - RETURNS
In accordance with the Belgian law on market practices and consumer protection of 6 April 2010, as the goods sold on the www.thea-jewelry.com website are made to the consumer's personalised specifications, the consumer does not have the right to cancel the purchase (right of withdrawal), the right of return or the right to exchange the products.
Once the order has been validated on the site, the user acknowledges that his/her acceptance is made in full consideration of the description of the jewel, the object of the sale, and that it constitutes a firm and irrevocable commitment. The sale is then considered complete, and the price is immediately due. From that moment onwards, the user has no right of rectification, exchange or return (particularly in the event of an error in size or text). For non-personalised items (in the Ready To Wear tab), there is a 14-day right of withdrawal.
Each piece of jewellery has a 2-year guarantee and a lifetime guarantee for orders after 1/2/24. If anything happens to your jewel during this period, we will be happy to take care of the repair. Please contact our after-sales service at hello@thea-jewelry.com to find out about the returns procedure.
Your jewellery will be returned to you free of charge within 2 to 4 weeks of receipt.
If your jewellery is no longer under guarantee, we can of course repair it for you.
Repair prices are as follows:
Jewellery with 1 to 3 diamonds missing: €50 excluding transport
Twisted jewel: €40 excluding transport
Jewellery broken between the chain and the letters: €40 excluding transport
Jewellery broken between the letters: €40 excluding transport
These prices are indicative only. We reserve the right to modify the repair price if your jewel is too damaged.

NB: Your parcel remains your responsibility until it is received by Thea Jewelry. For your security, we suggest that you send your parcels via a carrier that allows you to track your parcel to avoid any inconvenience. We also advise you to send your jewellery by a postal service that insures your parcel for the value of your goods. Please note that no additional customs fees will be paid by Thea Jewelry.
Thea Jewelry can in no way be held responsible for the delay or non-execution of the order if this is due to a technical cause or any other cause beyond its control. In this case, the site is entitled to delay transport and delivery, or to cancel the order.
Under no circumstances may the company be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or for any other event qualified as force majeure.
The content available on the www.thea-jewelry.com website is displayed without any guarantee of accuracy. Thea Jewelry cannot be held responsible for any damage arising from it, including direct or indirect damage, or loss of use resulting from the use of the site.
Thea Jewelry reserves the right to make changes to its site and its content at any time, including prices, descriptions and stocks, without notifying users, whether registered or not. If a condition is lacking, it will be governed by the procedures for distance selling companies based in Belgium.
These conditions apply for the entire duration of the online services offered by Thea Jewelry.
The computerised registers, kept in the computer systems of Thea Jewelry and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
ARTICLE 14 - APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions and any transactions arising from them are governed by and subject to French law.
