Terms and conditions of sale

Effective as of July 13, 2026

PREAMBLE

These General Terms and Conditions of Sale (hereinafter «GTC») govern all jewelry sales made by THEA JEWELRY, a brand operated by MAISON CANALI, a simplified joint-stock company (SASU) with a capital of €1,000, registered with the Trade and Companies Register under SIREN number 885 394 247 (SIRET 885 394 247 00013), with its principal place of business located at 188 route d’Eyguières, 13200 ARLES, France, represented by Ms. CANALI in her capacity as President, who can be contacted at the following email address: hello@thea-jewelry.com (hereinafter «the Seller»).

Sales are conducted through the website thea-jewelry.com (hereinafter «the Site»).

Any order placed on the Site implies the buyer’s (hereinafter «the Customer») full and unconditional acceptance of these Terms and Conditions. The Seller reserves the right to modify the Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date the order is placed.

ARTICLE 1 – SCOPE OF APPLICATION

These Terms and Conditions of Sale apply to all distance sales between the Seller and any Customer who is a consumer or non-professional within the meaning of the introductory article of the Consumer Code, regardless of the Customer’s nationality or country of residence, subject to the restrictions specified in Article 8 below regarding international shipments.

In the event of any conflict between these Terms and Conditions and any other document, these Terms and Conditions shall prevail, unless the parties agree otherwise in writing.

ARTICLE 2 - ORDERING

THEA JEWELRY offers two categories of jewelry, all handcrafted in France to order:

THEA JEWELRY pieces are crafted from 18-karat gold (yellow, rose, or white), sterling silver, or vermeil, as specified in each product's description.

2.1 Jewelry Collection

Jewelry offered in fixed designs, with no option for customization. These items are identified as such on their product pages on the Site.

2.2 Custom Jewelry

Jewelry crafted according to the specifications provided by the customer at the time of order: choice of metal (gold, vermeil, silver), stones, text, design, size, etc.

The photographs and images displayed on the Site are for illustrative purposes only. Slight variations in color or texture inherent in handcrafted products do not constitute a defect in conformity. The Seller reserves the right to remove or modify the products offered on the Site at any time.

ARTICLE 3- PRICES

The prices displayed on the Site are in euros (€), inclusive of all taxes (TTC), excluding shipping costs. The applicable shipping costs are indicated at the time the order is confirmed and are billed in addition to the price of the products.

The Seller is subject to French VAT. Its intra-Community VAT number is: FR34885394247.

For orders placed from a country outside the European Union, the total amount including tax displayed on the Site does not include any customs duties, local taxes, or import fees that may apply in the destination country; these remain the sole responsibility of the Customer (see Article 8).

The Seller reserves the right to change its prices at any time. The prices charged are those in effect on the date the order is confirmed.

ARTICLE 4 – ORDER

4.1 Ordering Process

To place an order, the Customer selects the desired product(s) on the Website, specifies any customization options as applicable, adds the items to their shopping cart, and proceeds to checkout. The order is considered firm and final upon receipt of full payment by the Seller.

An order confirmation is sent to the Customer via email to the address provided at the time of the order. This confirmation summarizes the details of the products ordered, any customization options, the price, and the estimated delivery times.

4.2 Availability

Product and price offers are valid as long as they are visible on the Site. If a product is unavailable after the order has been confirmed, the Customer will be notified as soon as possible and may choose a substitute product or cancel the order for a full refund, which will be issued no later than 30 days after payment of the amounts due.

4.3 Capacity to Enter into Contracts

The Customer represents that he or she has the legal capacity to enter into a contract. Any order placed by a minor or a person deemed legally incapacitated under the Civil Code shall be deemed null and void.

ARTICLE 5 – PAYMENT

5.1 Accepted Payment Methods

Payment for orders can be made using the following methods:

  • Credit card (Visa, Mastercard)
  • Apple Pay
  • PayPal
  • Bancontact
  • Alma (installment payments)

Payment is secured by a certified service provider. The Seller does not retain any of the Customer's banking information.

5.2 Payment in Installments (Alma)

Installment payments are offered through Alma, subject to the Customer’s eligibility. The specific terms (number of installments, any fees) are specified at the time of payment and are governed by Alma’s terms and conditions.

Alma’s credit service is offered for the settlement of purchases and the processing of payments, provided that the person purchasing the good or service through Alma («Buyer») accepts the installment or deferred payment agreement. Alma may charge fees. Any refusal by Alma to grant installment or deferred payment may result in the termination of the contract for the purchase of the good or service («Terms and Conditions»), unless the Buyer agrees to pay the purchase amount in full. In the event of termination of the T&C, the installment or deferred payment agreement will be automatically terminated. If you cancel the installment or deferred payment plan used for your payment, the T&C will be automatically terminated, unless you pay the full purchase amount in cash through Alma. If the product has already been shipped to you, you must return it within the maximum timeframe specified in these Terms and Conditions.

5.3 Security and Fraud

The Seller reserves the right to suspend or cancel any order in the event of suspected fraud, refusal of authorization by the bank, or any discrepancy regarding the provided contact information. The Seller also reserves the right to refuse or cancel any order placed by a Customer with whom there is a dispute regarding payment for a previous order, or who presents any form of risk.

ARTICLE 6 – OWNERSHIP AND TRANSFER OF RISK

Ownership of the products shall not transfer to the Customer until the Customer has paid the full price, regardless of the delivery date. Until full payment has been received, the products remain the exclusive property of the Seller.

For a consumer Customer, the risk of loss or damage to the product passes upon delivery of the product. For a business Customer, this transfer occurs as soon as the package is handed over to the carrier.

ARTICLE 7 – MANUFACTURING AND DELIVERY TIMES

All THEA JEWELRY pieces—whether from the Collection or Custom-Made—are handcrafted in France to order. Production takes 4 to 6 business weeks from the date the order is confirmed and full payment is received.

This lead time is approximate and may vary depending on the complexity of the part, the volume of current orders, or exceptional circumstances (holidays, workshop closures, force majeure). In the event of a significant delay, the Customer will be notified by email. If the delivery time exceeds the stated timeframe by more than 30 days without the Customer’s consent, the Customer may request cancellation of the order and a full refund of all amounts paid.

7.1 Delivery Timeframe

Once production is complete, the delivery time is added to the production time. As a general guide:

  • Mainland France (Colissimo): 2 to 5 business days
  • Belgium (Bpost or DPD): 3 to 5 business days
  • International (DHL, DPD): 5 to 7 business days, depending on the destination

These delivery times are approximate. The Seller shall not be held liable for delays attributable to carriers.

ARTICLE 8 – DELIVERY

8.1 Delivery Areas

The Seller offers delivery to mainland France, Belgium, and internationally. Shipping costs vary depending on the destination and are specified during the ordering process.

8.2 Carriers

Shipments are handled by Colissimo (France), Bpost (Belgium), and DHL (international). A tracking number is provided to the Customer as soon as the shipment is dispatched.

8.3 Receipt and Verification

It is the Customer’s responsibility to check the condition of the package and the products upon receipt. Any issues (damaged package, missing or defective product) must be reported to the carrier at the time of delivery and to the Seller at hello@thea-jewelry.com within 48 hours of receipt.

8.4 Liability and Lost Packages

Delivery is deemed to have been completed upon handover of the package to the carrier. In the event of a confirmed loss or damage, the Seller agrees to file a claim with the carrier and, as appropriate, to either produce a replacement or issue a refund.

ARTICLE 9 – INTERNATIONAL SALES

For orders placed from a country outside the European Union, the Customer is advised that:

  • Customs duties, local taxes, or import fees may be due upon delivery in the destination country.
  • These fees are entirely the responsibility of the Customer and are not included in the price displayed on the Website.
  • The Seller shall not be held liable for any delays or restrictions imposed by the customs authorities of the destination country.

It is the Customer's responsibility to verify the applicable regulations in their country before placing an order.

ARTICLE 10 – RIGHT OF WITHDRAWAL

10.1 Personalized Jewelry – Exclusion of the Right of Withdrawal

In accordance with Article L. 221-28(3) of the Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalized.

Since THEA JEWELRY’s personalized jewelry is custom-made according to the Customer’s choices (metal, engraving, size, stones, design, text, etc.), the Customer is expressly informed and agrees that no returns or refunds based on the right of withdrawal may be made once production has begun.

Confirmation of the order constitutes a firm and irrevocable commitment on the part of the Customer. The Customer may not request any cancellation, modification, or refund once the order has been confirmed, even before production begins.

10.2 Jewelry Collection – 14-day right of withdrawal

For non-customizable Collection jewelry, the Customer has the right to cancel the purchase within fourteen (14) calendar days of receiving the product, in accordance with Article L. 221-18 of the French Consumer Code, without having to provide a reason or pay any penalties.

To exercise this right, the Customer must notify the Seller of their decision by email at hello@thea-jewelry.com before the 14-day period expires. The return policy is as follows:

  1. The product must be returned in its original condition—unworn and undamaged—in its original packaging and box, along with the purchase receipt.
  2. The Customer is responsible for return shipping costs. We strongly recommend using a shipping method that includes a tracking number and insurance. The Customer remains responsible for the package until it is received by the Seller.
  3. A full refund of the product price (excluding the original shipping costs) will be issued within 14 days of receipt of the returned product, using the same payment method used when placing the order.

No returns will be accepted after the 14-day period has expired or for products returned in a condition that prevents them from being resold.

ARTICLE 11 – STATUTORY WARRANTIES AND AFTER-SALES SERVICE

11.1 Statutory Warranty of Conformity

In accordance with Articles L. 217-4 et seq. of the Consumer Code, the Seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The consumer has two (2) years from the date of delivery of the goods to take legal action.

Article L. 217-4 of the Consumer Code: «The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.»

Article L. 217-12 of the Consumer Code: «The right to bring a claim for lack of conformity expires two years after the delivery of the goods.»

11.2 Statutory Warranty Against Hidden Defects

In accordance with Articles 1641 et seq. of the Civil Code, the Seller is liable for latent defects in the property sold that render it unfit for its intended use. Any claim arising from such defects must be brought within two (2) years of the discovery of the defect.

Article 1641 of the Civil Code: « The seller is liable under the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so impair such use that the buyer would not have purchased it, or would have paid only a lower price for it, had the buyer known of such defects. »

Article 1648, paragraph 1, of the Civil Code: «An action arising from latent defects must be brought by the purchaser within two years of the discovery of the defect.»

11.3 Exclusions

The legal warranties referred to in Articles 11.1 and 11.2 cover manufacturing defects existing at the time of delivery of the item. They do not cover: normal wear and tear of the jewelry, natural tarnishing of metals, loss of rhodium plating, loss of the gold plating on vermeil resulting from normal wear and tear, impacts and accidental damage, scratches, or any alteration resulting from a modification, repair, or resizing performed by a third party other than the Seller. Any intervention by an unauthorized third party will void these warranties.

11.4 After-Sales Service Return Procedure

To exercise their rights under the statutory warranties, the Customer should contact Customer Service at hello@thea-jewelry.com, describing the defect found and attaching photographs of the jewelry.

The Customer then ships the jewelry at their own expense to the address provided by the Seller. It is strongly recommended to use a shipping method with a tracking number and insurance covering the value of the jewelry. The Customer remains fully responsible for the package until it is received by the Seller.

After the Seller has inspected the jewelry:

  • If the defect is confirmed and is due to a manufacturing defect, the Seller will repair or replace the piece of jewelry. The piece of jewelry will be returned to the Customer within 2 to 4 weeks.
  • If the damage is attributable to an external cause (impact, wear and tear, scratches, negligence, or modification by a third party): a repair estimate will be provided to the Customer before any work is performed. The Customer is responsible for all shipping costs (both ways).

The Seller assumes no liability for any loss or damage occurring during uninsured return shipping.

11.5 Repairs Not Covered by Warranty

Repair rates will be provided to the customer based on the customer’s repair request. No repairs will be performed without the customer’s prior written consent.

ARTICLE 12 – LIABILITY

The Seller shall not be held liable for any failure to perform its obligations in the event of force majeure as defined in Article 1218 of the Civil Code (including, but not limited to: natural disasters, epidemics, strikes, and government decisions).

The Seller shall not be held liable for any inconvenience or damage resulting from the use of the Internet, including, but not limited to, service interruptions, external intrusions, or the presence of computer viruses.

The photographs and product descriptions on the Site are provided for informational purposes only. Slight variations in color, texture, or dimensions inherent in handcrafted products do not constitute a lack of conformity.

Article 13 – PERSONAL DATA

In connection with sales and customer relationship management, the Seller collects and processes personal data about you (last name, first name, mailing address, email address, payment information, etc.) in its capacity as the data controller.

This data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Law No. 78-17 of January 6, 1978, on Information Technology, Data Files, and Civil Liberties. For any information regarding the processing of your data, your rights (access, rectification, erasure, portability, and objection), and how to exercise them, please consult our Privacy Policy available on the Website, or contact the Seller at hello@thea-jewelry.com.

ARTICLE 14 – INTELLECTUAL PROPERTY

All elements of the Site (text, photographs, images, logos, brand names, etc.) are the exclusive property of MAISON CANALI / THEA JEWELRY or are used with authorization. Any reproduction, display, modification, or distribution, in whole or in part, without the prior written authorization of the Seller, is strictly prohibited and constitutes an infringement punishable under the Intellectual Property Code.

ARTICLE 15 – CONSUMER MEDIATION

In accordance with Articles L. 612-1 et seq. of the Consumer Code, if a dispute cannot be resolved amicably, the Customer may, free of charge, seek assistance from the following mediation service:

CM2C – Consumer Mediation Center of Judicial Mediators

14 Rue Saint-Jean – 75017 Paris

www.cm2c.net  |  contact@cm2c.net

The Customer must first submit a written complaint to the Seller before referring the matter to the mediator. Mediation is free of charge for the consumer.

In accordance with Regulation (EU) No. 524/2013, the Customer may also use the European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

ARTICLE 16 – GOVERNING LAW AND JURISDICTION

These Terms and Conditions and any transactions arising therefrom are governed by French law.

These Terms and Conditions are written in French. In the event of a translation into another language, only the French version shall be deemed authentic in the event of a dispute.

In the event of a dispute, a consumer Customer may bring the matter before the court of his or her choice from among those with jurisdiction under the Code of Civil Procedure. In the event of a dispute between businesses, the court with jurisdiction shall be that within the jurisdiction of the Seller’s principal place of business.

ARTICLE 17 – SEVERABILITY

If any provision of these Terms and Conditions is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed unenforceable without affecting the validity of the other provisions, which shall remain in full force and effect.
